For customers located in Germany, the German version shall prevail in case of discrepancies. For international customers, the English version is provided for convenience and general understanding.

3. Scope of Application
These Terms & Conditions apply to all orders placed through our online shop and to all contracts concluded between Freakynuts® and consumers.
We sell exclusively to consumers (B2C), unless otherwise expressly agreed in writing.
By placing an order, the customer confirms that they have read and accepted these Terms & Conditions, our Privacy Policy, our Imprint / Legal Notice, and all product-specific information provided during checkout.
4. Products
Freakynuts® develops and sells unique bicycle components, technical bike parts, adapters, cockpit parts, brake-related components, and other products for bicycle and mountain bike applications.
Some products are technical components intended for installation on bicycles or other vehicles. Such products may be subject to increased mechanical stress, demanding use conditions, and specific compatibility requirements.
The customer is responsible for carefully reviewing all product descriptions, compatibility information, installation notes, dimensions, specifications, and warnings before placing an order.
Product images are for illustrative purposes only. Minor differences in color, surface finish, machining marks, anodizing, coating, packaging, or appearance may occur and do not constitute a defect, provided the product corresponds to the agreed technical specification.
5. Orders & Contract Formation
Products displayed in our online shop do not constitute a legally binding offer. They represent an invitation to the customer to place an order.
By clicking the final order or payment button, the customer submits a binding offer to purchase the selected products.
The contract is concluded when we accept the order by sending an order confirmation, payment confirmation, or shipping confirmation.
We reserve the right to refuse or cancel orders where reasonably necessary, including but not limited to:
- stock unavailability;
- technical or pricing errors;
- suspected fraud or misuse;
- legal or compliance-related restrictions;
- violation of these Terms & Conditions;
- orders placed by excluded commercial or logistics entities.
Any payments already received for cancelled orders will be refunded without undue delay using the original payment method, unless otherwise agreed.
6. Pricing & VAT
All prices are stated in EUR or in the currency displayed in the respective shop or checkout.
For our German / EU shop, and where applicable, we operate under the German Small Business Regulation pursuant to §19 UStG (Kleinunternehmerregelung). Therefore, no VAT is charged or shown on invoices where this regulation applies.
VAT is not applicable where the Kleinunternehmerregelung applies.
For international shops, including a US-facing shop, prices may be displayed in local currency. Currency conversion, taxes, import duties, customs fees, sales tax, use tax, or similar charges may apply depending on the customer’s location and are the responsibility of the customer unless expressly stated otherwise during checkout.
Prices may be changed at any time without prior notice. The price displayed at the time of order placement is binding.
7. Payment Methods
We accept major international payment methods, including credit cards, debit cards, PayPal, Apple Pay, and other region-specific options.
Payments are processed securely by certified third-party payment service providers, including Mollie B.V. and/or other payment processors used in the respective shop or checkout.
We do not store sensitive payment card information on our own servers.
The customer is responsible for ensuring that all payment details provided are accurate and that they are authorized to use the selected payment method.
8. Shipping & Delivery
Shipping costs are clearly displayed during checkout before the order is finalized.
We carefully package all products and ship them using reliable carriers.
Estimated delivery times are non-binding unless explicitly agreed otherwise. For EU consumers, delivery will take place within 30 days after order confirmation unless otherwise agreed.
Delivery times may vary depending on destination, carrier, customs processing, holidays, strikes, weather conditions, or other circumstances outside our control.
In accordance with EU consumer law, for consumer purchases the risk of loss or damage remains with us until the goods are delivered to the customer or to a person designated by the customer, unless the customer has independently arranged a carrier not offered by us.
9. International Shipments, Customs & Import Duties
We sell and ship internationally, including to customers outside the European Union and to customers in the United States.
For deliveries outside the EU, import duties, taxes, customs fees, brokerage fees, handling fees, or other charges may be imposed by local authorities or carriers. These charges are the responsibility of the customer unless expressly stated otherwise during checkout.
Shipments outside the EU are generally made under DAP (Delivered At Place) terms, unless otherwise stated.
The customer is responsible for complying with all import regulations and local laws applicable in their country.
We are not responsible for delays caused by customs clearance, import inspections, missing customer information, local authorities, or unpaid import charges.
If a shipment is refused, not collected, returned due to unpaid customs duties, or returned due to incorrect customer information, we may deduct the resulting shipping, return shipping, customs, storage, processing, and handling costs from any refund, to the extent permitted by law.
10. Business Customers & Delivery Restrictions
We sell exclusively to consumers (B2C), unless expressly agreed in writing in advance.
Orders placed by businesses, warehouses, distribution centers, logistics companies, freight forwarders, resellers, commercial workshops, purchasing agents, or other commercial entities are not accepted unless approved by Freakynuts® in writing.
We reserve the right to refuse, cancel, or reverse any order placed using:
- a business name;
- VAT number;
- commercial address;
- logistics warehouse;
- freight forwarding address;
- mail forwarding service;
- reseller account;
- address associated with distribution or commercial operations.
Delivery to such addresses is excluded unless the customer has been approved as a selected partner or authorized buyer by Freakynuts®.
11. Compatibility & Fitment Responsibility
Freakynuts® products are manufactured according to the technical specifications, intended application, and product information stated in the product description.
Proper fitment may depend on the complete bicycle configuration used by the customer, including but not limited to:
- fork model and fork standard;
- frame standard;
- axle standard;
- hub type;
- Boost or Non-Boost configuration;
- rotor spacing;
- brake system;
- end caps;
- adapters;
- wheel configuration;
- cockpit setup;
- third-party components;
- manufacturing tolerances of third-party parts.
Because we supply only the specific Freakynuts® component and do not control the customer’s complete bicycle, wheel, brake, hub, fork, frame, or cockpit configuration, the customer is solely responsible for verifying compatibility prior to purchase and installation.
Products that function according to the stated specification but are incompatible with the customer’s individual setup are not considered defective.
If the customer is unsure about compatibility, they should contact us before ordering or consult a qualified bicycle mechanic.
12. Installation & Assembly Disclaimer
Some products sold by Freakynuts® are technical components intended for installation on bicycles or other vehicles.
Installation and assembly must be carried out professionally and in accordance with all provided instructions, specifications, torque values, compatibility notes, safety warnings, and load limits.
Installation by the customer or by third parties is carried out entirely at the customer’s own risk.
We strongly recommend installation by a qualified bicycle mechanic where the product affects safety, braking, steering, wheel retention, suspension, cockpit setup, or other critical functions.
The customer may inspect the product to assess its nature, characteristics, and compatibility. However, installation, assembly, mounting, test-fitting, modification, cutting, filing, drilling, machining, or use of the product may constitute use beyond mere inspection.
If a product has been installed, mounted, test-fitted, modified, improperly assembled, or otherwise used, and this results in damage, functional impairment, wear, visible marks, or loss of resale value, we reserve the right to deduct an appropriate amount for loss of value or refuse a full refund where permitted by law.
Products that have been installed or show signs of use may therefore be excluded from full reimbursement where legally permitted.
13. Intended Use & Safety
Freakynuts® products must only be used for their intended purpose and within the limits stated in the product description, installation instructions, technical specifications, or other documentation.
The customer must regularly inspect the product for wear, cracks, deformation, looseness, damage, corrosion, abnormal movement, or other signs of failure.
The product must not be used if damaged, improperly installed, modified, incompatible, or if there is any doubt about its safety.
Participation in mountain biking, downhill, freeride, enduro, BMX, gravel, racing, bike park riding, extreme sports, and similar activities involves inherent risks. These risks are knowingly accepted by the user.
Freakynuts® shall not be liable for damage, accidents, injury, or loss resulting from:
- incorrect or improper installation;
- failure to follow installation instructions;
- failure to observe torque specifications or technical limits;
- use outside the intended purpose;
- incompatible third-party parts;
- modifications or alterations;
- unauthorized repair;
- misuse;
- crashes;
- impact damage;
- normal wear and tear;
- lack of maintenance;
- extreme riding conditions;
- professional racing or competition use unless expressly approved.
14. Right of Withdrawal & Returns for EU Consumers
Consumers located in the European Union have the legal right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period expires 14 days after the day on which the customer, or a third party designated by the customer other than the carrier, receives the goods.
To exercise the right of withdrawal, the customer must inform us by a clear statement, for example by email, sent to:
Returned goods must be sent back within 14 days after notification of withdrawal.
Unless the return is due to a defect or incorrect delivery, return shipping costs are borne by the customer.
The customer is responsible for packaging returned goods safely and securely.
15. Effects of Withdrawal
If the customer validly withdraws from the contract, we will refund all payments received, including standard delivery costs, without undue delay and no later than 14 days after:
- receiving the returned goods; or
- receiving proof that the goods have been returned.
Refunds will be issued using the original payment method unless otherwise agreed.
We may withhold the refund until we have received the goods back or until the customer has provided proof of return shipment, whichever occurs first.
We may deduct an appropriate amount for any loss of value resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
16. Exclusion from Withdrawal
The right of withdrawal does not apply to:
- goods made to the customer’s specifications;
- clearly personalized products;
- custom-made products;
- products modified or manufactured specifically for the customer;
- products that cannot be returned for legal or practical reasons where permitted by applicable law.
This does not affect the customer’s statutory rights in case of defective or non-conforming goods.
17. Returns for Non-EU Customers
Customers outside the European Union, including customers in the United States, may not have the same statutory right of withdrawal as EU consumers.
Any returns for non-EU customers are subject to our return policy as displayed on the website or agreed in writing.
Unless required by mandatory law or unless the return is due to a confirmed defect or incorrect delivery, return shipping costs, import charges, customs fees, and related costs are borne by the customer.
18. Defective or Non-Conforming Goods
If goods are defective or do not conform to the contract, the customer must notify us promptly after discovery.
In the case of confirmed defects or incorrect delivery, we will, at our discretion and in accordance with applicable law:
- repair the product;
- replace the product; or
- issue a refund if repair or replacement is not possible or reasonable.
In such cases, reasonable return shipping costs will be borne by us where required by law.
Damage caused by improper use, incorrect installation, incompatible third-party components, modification, crash impact, wear and tear, or failure to follow provided instructions is excluded.
19. Warranty
We warrant that the goods supplied conform to the product description and applicable legal requirements at the time of delivery.
This warranty applies only to defects that were already present at the time of delivery.
Normal wear and tear, improper use, incorrect installation, modifications, incompatible components, crash damage, lack of maintenance, corrosion, cosmetic damage caused by use, or damage occurring after delivery are excluded.
Nothing in these Terms limits or excludes the customer’s statutory rights under applicable consumer protection law.
20. Limitation of Liability
Our liability is unlimited in cases of intent or gross negligence, and for death, personal injury, or damage to health caused by our negligence where such liability cannot be excluded by law.
Our liability is also unlimited where mandatory product liability laws apply.
In all other cases, liability is limited to foreseeable, direct damages typical for this type of contract, and where legally permitted, limited to the purchase price of the product concerned.
We shall not be liable for indirect damages, consequential damages, loss of profit, loss of use, downtime, replacement bike costs, workshop costs, race fees, travel costs, or other consequential losses, except where liability cannot be excluded by law.
Nothing in these Terms affects mandatory statutory consumer rights.
21. Ownership & Risk
Ownership of goods remains with Freakynuts® until full payment has been received.
For consumer purchases, risk passes to the customer upon delivery in accordance with applicable consumer protection law.
22. Intellectual Property
Freakynuts® is a registered trademark.
All products, product concepts, designs, engineering solutions, CAD models, technical drawings, prototypes, dimensions, specifications, photographs, videos, graphics, logos, trademarks, product names, website content, manuals, installation guides, product descriptions, packaging designs, and documentation are the intellectual property of Freakynuts® or its licensors, unless otherwise stated.
Our products are the result of substantial research, development, testing, prototyping, engineering, and product refinement.
The purchase of a Freakynuts® product transfers ownership of the physical product only. No intellectual property rights, copyrights, design rights, patent rights where applicable, trademark rights, know-how, reproduction rights, commercial use rights, licensing rights, or other proprietary rights are transferred to the purchaser.
Without our prior written permission, the customer or any third party may not:
- copy or reproduce any Freakynuts® product or design;
- reverse engineer, duplicate, manufacture, CNC-machine, cast, 3D print, scan, digitize, or otherwise replicate our products or parts thereof for commercial purposes;
- create derivative products based on our engineering solutions, technical concepts, dimensions, designs, or product architecture;
- commission a third party to reproduce, manufacture, modify, or commercially exploit a Freakynuts® product or design;
- sell, distribute, advertise, import, export, or otherwise commercially exploit copies, imitations, replicas, or derivative products;
- use our product photographs, videos, graphics, manuals, website content, logos, product names, or documentation for commercial purposes;
- remove, alter, or obscure any trademark, logo, product marking, copyright notice, or proprietary marking;
- register or attempt to register any confusingly similar trademark, design, domain name, product name, social media handle, or other identifier;
- falsely suggest any partnership, authorization, sponsorship, or affiliation with Freakynuts®.
Any unauthorized use constitutes an infringement of our intellectual property rights and may result in legal action, including claims for injunctive relief, damages, recovery of legal costs, destruction of infringing goods, and any other remedies available under applicable law.
Nothing in this clause limits any rights that cannot lawfully be excluded under applicable legislation.
23. Product Development & Reverse Engineering
Freakynuts® products are developed through substantial research, engineering, testing, prototyping, and product development.
The purchase, possession, inspection, or use of a Freakynuts® product does not grant any right to copy, reproduce, manufacture, commission, modify for commercial purposes, or otherwise exploit the product design, engineering concept, dimensions, technical solution, or know-how.
Commercial reverse engineering, duplication, reproduction, imitation, cloning, manufacturing, or distribution of products or parts based on Freakynuts® designs is strictly prohibited without our prior written consent.
This includes reproductions made by CNC machining, 3D printing, casting, scanning, measuring, CAD reconstruction, digital modelling, or any comparable manufacturing or replication process.
Nothing in this clause prohibits lawful private use where such use cannot be restricted by mandatory law. However, any commercial copying, manufacturing, resale, distribution, or exploitation is strictly prohibited.
24. Product Images, Media & Website Content
All photographs, renderings, videos, installation guides, graphics, icons, manuals, product descriptions, website texts, branding assets, and other media published by Freakynuts® remain our exclusive property or are used under license.
These materials may not be copied, downloaded, modified, republished, distributed, scraped, mirrored, used in advertisements, used in online marketplaces, or used for commercial purposes without our prior written permission.
Dealers, distributors, media partners, or selected partners may only use official marketing materials supplied directly by Freakynuts®, and only subject to the applicable written agreement or authorization.
25. AI, Automated Collection & Data Mining
Unless expressly permitted in writing, no content published by Freakynuts®, including product descriptions, technical specifications, photographs, drawings, manuals, CAD files, graphics, website content, databases, product data, or documentation, may be used for artificial intelligence training, machine learning, automated scraping, data mining, model training, dataset creation, or similar technologies.
Unauthorized automated collection, extraction, reuse, or analysis of our content constitutes an infringement of our rights and may result in legal action.
26. Counterfeit Products & Unauthorized Resale
Freakynuts® does not authorize the sale of counterfeit, copied, cloned, imitation, or unauthorized derivative products.
We reserve the right to take action against any person or entity that manufactures, sells, imports, exports, advertises, distributes, or facilitates counterfeit or unauthorized copies of Freakynuts® products.
Unauthorized resale in a manner that suggests official partnership, warranty coverage, dealer status, or authorization is prohibited.
Warranty, support, and product authenticity guarantees may be refused for products purchased from unauthorized sellers, marketplaces, or unknown sources where authenticity cannot be verified.
27. Privacy & Data Protection
Customer data is processed in accordance with applicable data protection laws, including the GDPR where applicable.
Personal information is used for order processing, payment handling, delivery, customer communication, fraud prevention, legal compliance, and related business purposes.

28. Electronic Communications
The customer agrees that order confirmations, invoices, terms, withdrawal information, legal notices, product instructions, shipping updates, and other communications may be provided electronically, including by email or through the customer account.
The customer is responsible for providing a valid email address and for checking spam or junk folders.
29. Force Majeure
We shall not be liable for delays or failure to perform obligations caused by circumstances beyond our reasonable control, including but not limited to:
- natural disasters;
- war;
- terrorism;
- strikes;
- transport disruptions;
- customs delays;
- pandemics;
- government restrictions;
- power failures;
- supply chain disruptions;
- carrier delays;
- cyberattacks;
- technical failures outside our control;
- shortages of materials or components.
If such circumstances substantially affect performance, delivery times may be extended for the duration of the disruption.
30. Severability
If any provision of these Terms & Conditions is found to be invalid, unlawful, or unenforceable, the validity of the remaining provisions shall remain unaffected.
The invalid provision shall be replaced by a valid provision that comes as close as legally possible to the economic and legal purpose of the original provision.
31. Entire Agreement
These Terms & Conditions, together with the order confirmation, product descriptions, Privacy Policy, Imprint / Legal Notice, and any product-specific instructions or warnings, constitute the entire agreement between the customer and Freakynuts® regarding the purchase.
Any deviating terms of the customer shall not apply unless expressly accepted by Freakynuts® in writing.
32. No Waiver
Failure by Freakynuts® to enforce any right or provision under these Terms shall not constitute a waiver of such right or provision.
33. Governing Law
These Terms and any contracts formed under them are governed by German law.
For consumers located in the European Union, nothing in these Terms affects mandatory consumer protection rights that apply in the customer’s country of residence.
For customers outside the European Union, including customers in the United States, German law applies to the extent permitted by applicable mandatory local law.
The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.
34. Jurisdiction
Where legally permitted, disputes shall be subject to the jurisdiction of the competent German courts.
For consumers, mandatory statutory jurisdiction rules remain unaffected.
35. Alternative Dispute Resolution
We are not obliged to participate in dispute resolution proceedings before a consumer arbitration board unless required by mandatory law.
The former European Online Dispute Resolution platform has been discontinued by the European Commission and is no longer available.
